Police Officer Charged with Sexual Battery after Date Rape

Assault and Possession of Drugs

(FL) – John Finley, with the Fernandina Beach Police Department, was charged with multiple crimes after a woman came forward accusing him of date rape. The unidentified woman went to Finley’s apartment “after getting to know each other after exchanging text messages.” Finley gave her a drink and she began feeling sleepy and unable to move. She suggested they watch a movie, but Finley took her into his bedroom.

The woman says Officer Finley assaulted her several times even though she kept telling him no. Finley eventually fell asleep. Once the drugs wore off, the woman left and told a friend what had happened. Her friend recommended she take a drug test. “The ’12Panel’ drug test she took came back positive for amphetamines.” The victim reported the assault to the police.

Criminal Investigation

The Nassau County Sheriff’s Office conducted the criminal investigation. They obtained a warrant to search Finley’s apartment. A police K-9 alerted to the presence of narcotics in the bedroom. A cup and a black container, both had residue that tested positive for amphetamines. John Finley was asked where he obtained the illegal drugs, but his answer was redacted from the warrant details.

The warrant details stated that Finley mocked the victim when she told him no. It also states that “throughout the alleged assault, Finley told her: ‘I shouldn’t be doing this.'”

Finley denied having sexual intercourse with the victim. She claims he repeatedly removed her clothes, touched her intimately, forced her to touch him, and attempted oral sex.

Criminal Charges Filed

33-year old John Lee Finley Jr., was charged with “two counts of sexual battery and one each of battery and drug possession.” He was booked into the Duval County Jail. His bond was set at $597,508.

Based on the details in the Sheriff’s Office investigation, the city of Fernandina Beach terminated Finley on Monday, according to a Police Department statement.
